Bayly Pr & Clearshot Digital $30k Podcast Giveaway Terms and Conditions

1. Promoters

The promoters of this giveaway are:

• BAYLY PR Pty Ltd (ABN 56 665 953 711), located at 4059, Queensland, Australia.
• Clearshot Digital Pty Ltd (ABN 95 619 708 593), located at 4064, Queensland, Australia.

(Collectively referred to as “the Promoters”).

2. Type of Promotion

2.1 This is a Game of Skill competition, meaning winners are selected based on the merit of their entries rather than by chance.

2.2 No permit is required for this competition under Queensland law.

3. Legal Compliance

3.1 In accordance with Section 154 of the Australian Consumer Law (ACL), the Promoters must award the advertised prize and cannot cancel the promotion due to low participation.

3.2 Under Section 18 of the ACL, the Promoters must ensure all promotional materials are not misleading or deceptive. This includes clear communication about the prize value and details.

3.3 The total estimated prize value is $30,000, comprised of:

• $20,000 worth of podcast production provided by Clearshot Digital.
• $10,000 worth of talent representation provided by Bayly PR.

4. Eligibility

4.1 Entry is open to residents of South East Queensland, aged 18 years and over.

4.2 Employees of BAYLY PR, Clearshot Digital, associated agencies, and their immediate family members are not eligible to enter.

4.3 Entrants must be available to record in the Brisbane-based Clearshot Digital studio.

5. Promotion Period

5.1 The competition commences at 9:00 AM AEST on Tuesday, 18 February 2025 and closes at 11:59 PM AEST on Tuesday, 18 March 2025.

5.2 Entries submitted outside the Promotion Period will not be considered.

6. Entry Requirements

6.1 To enter, participants must:

• Pitch their podcast idea to Bayly PR and Clearshot Digital.
• Submit their pitch via one of the following methods:
  • Post their video pitch on social media, tagging @clearshot_digital and @baylypr.
  • Send their video pitch via email to lulu@baylypr.com.
  • Direct message their video pitch to either @clearshot_digital or @baylypr.

6.2 Multiple entries are not permitted; each entrant may submit one pitch only.

6.3 The Promoters reserve the right to disqualify entries that:

• Contain offensive, defamatory, or inappropriate content.
• Do not comply with the entry requirements.
• Are suspected of using fraudulent or automated methods of entry.

7. Judging Criteria

7.1 This is a Game of Skill competition, and chance plays no part in determining the winner.

7.2 Entries will be judged based on:

• Creativity of the podcast concept.
• Originality of the idea.
• Potential impact and engagement of the podcast.

7.3 Judging will take place on 19 March 2025, with winners selected by a panel appointed by the Promoters.

7.4 The judges’ decision is final, and no correspondence will be entered into.

8. Prize Details

8.1 The prize package consists of:

• $20,000 worth of podcast production from Clearshot Digital.
  • Includes up to 20 recorded, filmed, and edited episodes in the Clearshot studio in Milton, Brisbane.
  • If production costs exceed standard rates due to additional studio time or extra editing, the number of episodes may be reduced at the discretion of the Promoters.
• $10,000 worth of talent representation from Bayly PR.
  • Includes a 6-month talent management contract, industry support, ongoing consultancy on podcast direction and personal brand identity, development of media kit and rate card,  and proactive outreach and reactive management of relevant partnership opportunities. BPR cannot guarantee media coverage placements or paid partnerships/collaborations. BPR will manage all paid partnerships and deals using their standard commission-based structure with more details being provided upon announcement of the winner. 

8.2 The Clearshot Digital studio is located in Milton, Brisbane. It is a sound-dampened space, not a fully soundproofed recording studio, but is equipped with high-quality video and audio equipment, professional lighting, and comfortable studio seating.

8.3 The winner must record in the Clearshot studio in Brisbane; remote recordings are only permitted for guests who cannot attend in person.

8.4 The prize is not transferable, exchangeable, or redeemable for cash.

8.5 If additional recording time, editing, or production services beyond the standard package are required, the winner may be responsible for additional costs.

9. Winner Notification & Prize Claim

9.1 The winner will be notified via email, phone, or direct message within 72 hours of the judging. There is no need for entrants to follow up.

9.2 The winner must claim the prize within 7 days by following the instructions provided in the notification.

9.3 If the winner does not respond within the stipulated timeframe, the Promoters reserve the right to select another winner.

10. Privacy and Data Use

10.1 The Promoters will not use or distribute entrants’ personal information without explicit consent, except as required by law.

10.2 Entries submitted via email or direct message will not be shared, used for marketing, or stored beyond the duration of the giveaway.

10.3 The Promoters will comply with the Australian Privacy Act 1988 in handling entrants’ personal data.

11. Publicity Release

11.1 By entering this giveaway, entrants agree that the Promoters may use their name, image, and entry content for promotional purposes without further compensation, unless the entrant requests otherwise.

12. Limitation of Liability

12.1 The Promoters are not responsible for:

• Any technical issues (internet failures, server errors, etc.) affecting entry submission.
• Lost, delayed, or misdirected entries.
• Any injury, loss, or damage arising from participation in the giveaway or acceptance of the prize.

13. Right to Terminate Participation

13.1 The Promoters reserve the right to disqualify a winner and withdraw the prize if, at any time before or after awarding the prize, the winner:

• Is found to be engaging in offensive, discriminatory, defamatory, or unlawful conduct (online or offline).
• Promotes hateful, violent, misleading, or inappropriate content.
• Is involved in scandals, controversies, or behaviour that could negatively impact the Promoters’ reputation.
• Uses the prize in a way that could bring the Promoters into disrepute.

13.2 Clearshot Digital and Bayly PR reserve the right to cancel the winner’s contract at any time, for any reason.

13.3 The Promoters retain full editorial control over advertising content placed within the winning podcast, including 30-second advertisements from Clearshot Digital and Bayly PR.

14. Changes to Promotion

14.1 The Promoters reserve the right to cancel, modify, or suspend the competition if unforeseen circumstances arise, but will still ensure a prize is awarded per ACL Section 154.

15. Governing Law

15.1 These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes will be handled in accordance with Queensland law.
